Judge Overturns Tom Brady's Four-Game Suspension

Tom Brady will not be suspended for four games after he was allegedly “generally aware” of a scheme to deflate AFC Championship game footballs in earlier this year.

Tom Brady's four-game suspension by the NFL has been overturned by a federal judge. In a ruling issued TK, Judge Richard Berman said Thursday.

The decision can be appealed to a higher court, but Judge Berman has warned that the entire process could take up to two years to resolve. "And I don't think anyone wants that," he said during a hearing in early August.

The lawsuit centered on the power afforded to NFL Commissioner Roger Goodell under the NFL and NFL Players Association's Collective Bargaining Agreement, which gives Goodell near-unilateral power when determining a player's punishment for policy violations.

Brady was suspended four games after an investigator determined he was "generally aware," if not orchestrating, a scheme to deflate game-use footballs to gain an alleged competitive advantage against the Indianapolis Colts in the 2015 AFC Championship game.

Brady appealed, with backing from the NFLPA, and asked Goodell to recuse himself as appeal arbitrator. Goodell refused, and after a ten-hour hearing at NFL headquarters in Manhattan, Brady's suspension was upheld. In his decision, Goodell said new evidence that Brady had "destroyed" his cell phone — which the quarterback says is a routine practice due to his celebrity — rather than turn it over to investigators weighed into his decision to maintain the four-time Super Bowl winner's suspension.

As the lawsuit played out over the last four weeks, Judge Berman continued to push each side to reach a settlement. Though many different scenarios and offerings by either side have been reported — reduced games for Brady admitting to tampering being the most common among them — the parties were "not close" on Monday when the parties met in court for a third and final time.

12 Ideas You Can Steal from Wheels On the Buses

The big yellow school tour bus that pulls up at the corner may complete your consummate picture of being a mother, apple pie and sending your children off to a fine education. But the the main picture that many don’t see is just how much it costs to keep that big, yellow, gas-guzzling car operating safely, on moment and operating well. Paying to operate any fleet of Wheels on the bus
buses just would be the silent problem that will keep many a school board member awake in the evening.

According to the Nationwide Highway Traffic Safety Supervision, school buses are your safest mode of travelling to and from school in the us. Each year, approximately 450, 000 general public school buses travel roughly 4. 3 billion a long way.

Keeping them rolling, however, requires fuel — and also that’s been expensive recently. School boards and university systems’ management are constantly seeking approaches to economize their school coach fleet through better administration and optimizing routes and also controlling their flow.

Inefficient routing and rising fuel costs have grown a cost burden in operating budgets, and have lead district transportation managers to turn to technology to build efficiency where when possible.

Global Positioning Systems (GPS) are the type of technology. GPS systems offer besides positioning information in true or delayed time, just about all gives vehicle position heritage, travel route, with speed and time, student identification, emergency alert and automatic accident notification.

The Kansas Public Schools became one of many first school districts near your vicinity to implement GPS answers in its school buses in the past. The district has a few 43 schools — 30 elementary schools, eight center schools and five high schools, and approximately 21, 750 students.

Kansas Public Schools outfitted GPS-enabled devices onto the district’s 157 buses, allowing instant voice communication between drivers and the district’s transportation office. The solution provided the dispatcher have real profit give school bus owners their mapped route along with driving directions and moment expectations, and allowed drivers the capability to contact 911 within the emergency.

The school district was aimed at safety as a top priority, like most school districts. Integrating GPS was a method to deploy technology to enable administrators and dispatchers to know and locate the status of each and every school bus transporting little ones, in real time.

School transportation planners that use technology-assisted route progress and route-planning software have to be careful to not industry off efficiency for basic safety. Route-planning technology can possibly be limited in its role in offering of school bus stops. Care have to be taken not to place a higher priority on efficiency compared to safety. For example, locating a school bus stop on the secondary street may remove the bus from an arterial that gives a more direct way.

GPS handsets helped wedding planners maintain and operate a competent bus transportation department, allowing them to monitor and make probably the most efficient use of tour bus scheduling demands. The Global positioning system wirelessly transmits real-time location information on the dispatch center to a server where data is monitored because of the district’s transportation department permitting transportation officials to monitor the place of the buses. The information is monitored along the route as they pick up and drop off students. This is one more feature that allows school authorities to produce vigilance and ultimately more safety for your pupils’ whereabouts.

The location of each bus might be displayed on a map so administrators is able to see and know where buses are at the same time; in addition, the same might be displayed on a smartphone. Knowing this and other info on where and when a bus travels allows analysis being performed to determine as well as efficient route and time for it to travel that prevents idling and also distance
.
When the Price range Drives the Bus

What happens when your board of education says cut your capacity to pay and there’s no easy destination to cut without it impacting on the underlying program? Effectively it happened in Lansing, N. Y.

Recently, the board of education and learning in Lansing posed surprise challenge to their Transportation department — cut the budget by $90, 000. Lansing institution buses move some 1, 222 individuals over 300, 000 miles yearly and transport students to private schools, vocational plans, athletic events and support many school events.

The board of transportation had a brand new challenge. They sought the assistance of technology that could possibly help them by rescheduling tour bus routes and travel times. They purchased software through Transfinder — a provider of transportation management software to a lot school districts. It allowed Lansing in order to reroute their school buses and ultimately travel carefully computed distances that were most efficient and consumed the smallest amount of fuel. Applied against a total fleet of school buses, the savings in fuel consumption adds up. They did in fact accommodate their $90, 000 problem, by knowing where his or her buses were, where they had to be and pinpointing the shortest distance to produce it happen. Consequently, the particular shorter distances translated to be able to shorter travel times in addition to ultimately lower incremental fuel consumption.

Making decisions about exactly where school bus stops is going to be placed requires balancing conditions that might be ideal with the realities of any community’s road system, weather and topography. In this kind of discussion, ideal characteristics tend to be described, but these characteristics will rarely all be met for any school bus stop. Transportation directors must seek to try and do everything possible for student safety with poor conditions.

The Lansing travel board use their new software to plan along with optimize routes, and utilized GPS technology to be the cause of real-time positions of the varsity buses. The software allowed them to see granular information including who was on this bus and what roadwork could possibly impact schedules.

By eliminating inefficient bus runs, reducing mileage and the following effects of these types of factors on other managing expenses, they easily built their $90, 000 reduction target — in fact it was more
like $100, 000.

Minimizing Operating Costs in A lot more Ways Than One

Lansing isn’t the only community employing location technologies for bus route search engine optimization. Many other communities are executing it as well.

Several years ago, the Nash Rocky Attach Public Schools in Rugged Mount, N. C., used routing software for his or her buses but didn’t get as firm a grip on the whereabouts of their buses because they would have liked. They taken on a product from Daily Solutions, Inc., a provider of GPS-driven transportation information for K-12 marketplace.

They could actually use the data in the AVL software to cut costs in fuel and maintenance costs by making sure the bus is making the proper number of stops and also driving the planned avenues — the shortest ones and never some other route with their own making.

The same company also took on the Charlotte County Public Schools (CCPS), in Port Charlotte, Fla., after the transportation director with the district felt they didn’t use a real good sense of their day-to-day transportation operations once the buses left the compound. In the first year of while using the software, CCPS was competent to employ optimized routes, pickups and guidelines in their operations to achieve recognizable savings.

There was a 15- to 20-minute variation between actual driving periods versus reported driving time — which CCPS states that saved them $50, 000 a single year. Add to this particular another $4, 000 in fuel prices by reducing unnecessary idling on the engines and, ultimately, they really reduced their overall costs.

GPS technology and route-planning software might not exactly work for every university system, district or schooling board; however, in today’s trim and mean budgetary instances, technology of this type might easily pay for itself in a short period given the rising price of fuel and classes buses. Talk to some sort of school board representative, and yes it will sound like a new broken record — demand is the same for education, even so the budget is strangled. In times like these, a dollar put down today inside the name of efficiency can mean regarding green dollar returned in fuel savings in a few years or less.

Two Kansas City Royals Players Have The Chickenpox

Two members of the Kansas City Royals — outfielder Alex Rios and relief pitcher Kelvin Herrera — have contracted the chicken pox, the Kansas City Star reported. Each player could be out for up to two weeks.

The Royals, who are in good standing for the playoffs and expect to play into October, are taking precautions to keep the chickenpox from spreading to more players, according to the Star. Rios, who was scratched from Saturday's lineup about an hour before the game against the Tampa Bay Rays in Florida, is believed to be the first player to get sick. He was sent home via a private jet, the Star reported. Herrera soon reported similar symptoms and was quarantined and sent home.

Chickenpox is significantly more dangerous in adults than it is children, Rafael Harpaz of the Center for Disease Control and Prevention, told the Star. "The likelihood that they'll end up getting pneumonia is much higher. That's pretty rare in children. So there's a number of complications that are more common in adults than in children," he said.

The Royals have asked players to confirm with their parents that they are immune to chickenpox, or get vaccinated. The virus is highly contagious, and can be contracted through "air or bodily contact," which makes a baseball clubhouse an easy place for it to spread.

During a press conference Tuesday, manager Ned Yost addressed Rios and Herrera's health and other members of the team were asked about whether they were concerned about getting sick. Yordano Ventura and recently acquired outfielder Jonny Gomes answered in jest:

No, The Deflategate Judge Isn't Going To Announce His Decision On Twitter

Speculation and deception run rampant Tuesday as a federal judge prepares to make his decision in the Tom Brady vs. NFL saga this week.

Judge Richard Berman

Darren Ornitz / Reuters

Judge Richard Berman on Tuesday said he expects to announce his Deflategate decision in the lawsuit between the NFL and its players union on behalf of Tom Brady is expected within the week.

Fans and other stakeholders have been pinning for an end to the drawn out drama, in which the New England Patriots are accused of deflating footballs used in the AFC Championship Game against the Indianapolis Colts.

At a court hearing Tuesday, Berman hinted that could announce his decision later in the day or on Wednesday, although attorneys could appeal. The whole ordeal over Deflategate could also be booted back into NFL arbitration.

For fans, the legal back and forth and drawn out arbitration process has been taxing. And on Tuesday afternoon, as Deflategate pivoted to "Deflatewait," someone created a Twitter account with the handle @JudgeBerman, and posted the following tweet:

Twitter: @judgeberman

Anxious fans fell for it, and Berman's deputy immediately received "several phone calls from reporters" asking about the validity of the account. Over the phone, a person in Berman's court said he "definitely did not tweet that he's issuing a decision at four."

The practice of creating fake accounts to dupe users is a long-held tradition in Sports Twitter. Fans create accounts that look like those of national reporters, using deceptive character tricks, such as an uppercase "i" to substitute a lowercase "L" for a news-breaker like baseball reporter Ken Rosenthal.

But Tuesday's trolling still left those who wrongly believed a federal judge would break all established protocol to tweet a legal decision left wanting to know exactly how it would be disseminated.

Here's how the decision will likely unfold:

The decision will be filed to court records, which will be quickly available online. Based on Berman's previous decisions in similar cases, it will likely be about 20 pages in length. Everyone with access to an online records program such as PACER — Brady, Goodell, attorneys, and reporters alike — will then find out at about the same time.

News reports will then no doubt be sent into a frenzy — just watch out for the fake accounts.
